Promise to make a gift (Schenkungsversprechen)

A promise to make a gift (Schenkungsvertrag) is a contractual agreement in which the donor promises to make a transfer if both parties are in agreement that such transfer is gratiously.  A promise to make a gift is unvalid unless it is notarized by a German notary (§ 518 BGB). A defective form is cured by rendering the performance promised (§ 518 BGB).
