Victoria: Inkrafttreten des Justice Legislation Amendment (Succession and Surrogacy) Act 2015

2014 wurde der der Justice Legislation Amendment (Succession and Surrogacy) Bill dem Parlament vorgelegt. Teil 1 (Preliminary) and Teil 6 (Surrogacy) wurden am 30. Oktober 2014 wirksam. Die verbleibenden Bestimmungen des Justice Legislation Amendment (Succession and Surrogacy) Act 2015 sind am 01.07.2015 in Kraft getreten. Der Hauptzweck des Gesetze ist die Ergänzung des Administration and Probate Act 1958 (Vic) betreffend 

  • Unterhalt nach dem Tod (family provision claims),
  • Haftung des Nachlasses für Schulden des Erblassers,
  • vereinfachtes Verfahren für kleine Nachlässe (administration of small estates) und
  • die Ergänzung der gerichtlich bestätigten Testamente von Testierunfähigen (court authorised wills scheme) nach dem Wills Act 1997
