Court custody of a Will (amtliche Verwahrung)

A notarized Will is always given in court custody. It is revoked by withdrawal from court custody (amtliche Verwahrung). See § 2256 BGB. A holographic Will may be given in Court custody. Withdrawal of a holographic will does not invalidate it. Pursuant to § 348 FamFG (Opening of Dispositions mortis causa) any will in court custody is opened, once the court has received knowledge of the death of the testator.
