Parental custody (elterliche Sorge)
Parental custody is the duty and right of the parents to care for a minor child. See § 1626 (1) of the German Civil Code (BGB). The parental custody includes the care for the person of the child (Personensorge) and the property of the child (Vermögenssorge). Pursuant to § 1627 BGB the parents must exercise the parental custody on their own responsibility and in mutual agreement for the best interests of the child. In the case of differences of opinion, they must attempt to agree. Purusant to § 1629 BGB parental custody includes the representation of the child.
