Mit Wirkung zum 1. Juli 2016 wurde in die Florida Statutes sec. 731.1055 eingefügt. Hiernach werden Immobilien in Florida immer nach dem Recht von Florida vererbt. Bisher war der Rechtsprechung der Gerichte von Florida mangels einer Rechtswahl zum Recht von Florida im Falle des Todes einer nicht-residenten Person Erblasser auch auf Immobilien in Florida das Recht des Domizils anzuwenden (siehe Saunders v. Saunders,. 796 So. 2d 1253, 1254 (Fla. 1st DCA. 2001) und 819 So. 22nd 139 [2002]).
