Jurisdiction (internationale Zuständigkeit)

German courts have jurisdiction in estate matters if decedent`s habitual residence at the time of his death was in Germany. See Art. 4 of the European Succession Regulation. However, where the law chosen by the deceased to govern his succession pursuant to Article 22 is the law of a Member State, the parties concerned may agree that a court or the courts of that Member State are to have exclusive jurisdiction to rule on any succession matter. See Art 5 of the Regulation. 

The local juridiction / venue is determined under § 343 FamFG.
